Puppy Sales Agreement & Health Guarantee

Thank you for choosing a puppy from Golden Doodles of North America . Adding a new puppy to your family is a very exciting time and is a big commitment. It’s very important that you read over and understand the sales agreement and health guarantee. A lifetime of breeder support for is always available for your puppy!

Credit or debit card will be accepted for final payment if you are coming to pick up or to have Golden Doodles owners deliver your puppy. If a puppy is being delivered/shipped via pet nanny , then final payment plus shipping and handling fees will be due 2 weeks prior to the delivery period. We do offer free puppy delivery up to 75 miles from Corinth, TX .

Short Term Health Guarantee

This puppy is guaranteed to be in good health, to the best of the seller’s knowledge. Buyer has 72 hours, from the date of ownership in which to have the puppy checked by a licensed veterinarian. Failure to have puppy checked by a licenses veterinarian within 72 hours will void health guarantee. Buyer must e-mail or send a copy of the vet visit record to Golden Doodles of North America contacts.


After 72 hours, of the health guarantee period, the seller cannot be held accountable for future diagnosis of bacterial or viral infectious diseases,  giardia, parasites, fungi, etc. since these can be contracted anywhere in the environment after leaving and are not a result of genetic or breeding. If there is a problem that cannot be rectified the buyer may return the puppy to seller, at buyer’s expense, no later than the day following the vet exam, along with a veterinarian’s statement stating the problem. Upon the puppies return, you will have the right to own another puppy of the same breed from a current or future litter.


(Exclusion: This does not include the presence of parasites and does not apply to a health problem resulting from an injury or accident due to buyer’s negligence), the following provisions will be honored. All medical expenses are the sole responsibility of the buyer. All puppies are vaccinated and treated for worms and giardia before they leave. However, buyer need to be aware that these things can arise and that they are usually not serious (even though seeing blood in the stool appears serious) and are easily treated and seller will not cover the treatment for them after the puppy leaves our possession. Viral and bacterial diseases and bloody stools (form of worms) are not covered in the health guarantee as they are natural things puppies can pick up from anywhere. Umbilical Hernias also referred to as “outie” belly buttons are also not covered in the heath guarantee. Puppies are naturally at risk for viral and bacterial diseases and worms which are often brought on by the stress of a new home, new food, new people, or just a change in environment.



Long term Health Guarantee

The puppy is guaranteed against congenital life threatening defects up until it is 3 years old. If there are any congenital life-threatening defects, they should become present well within that time period. Should anything arise within this time due to a congenital life-threatening defect, the puppy will be replaced by one of the same qualities and value when the next becomes available. There will be no cash refunds. The replacement will only be given if a necropsy has been performed and a certificate from a licensed vet is provided as proof of death. The cost of necropsy will be responsibility of buyer. The buyer must contact the breeder immediately upon discovery of a life-threatening genetic defect. Any delay in doing so, voids this guarantee. This guarantee does not include expenses associated with the vet check, OFA exams, vaccinations, worming medication, transportation, carrier, and other fees. The health guarantees mentioned in this agreement do not cover accidental death, neglect, abuse, or injuries that the puppy sustains in the care of the buyer. Any health related issues or loss of life due to reactions caused by vaccinations or flea and tick preparations administered either orally or on the skin are not covered under this guarantee. No warranty or guarantee is made to the disposition, life-span, size, color, show quality or breeding quality of any puppy. Retained testicles and hernias are excluded from this guarantee. In the case of sudden death of the puppy, seller must receive a written notice of puppy’s death from buyer’s vet, along with a necropsy report indicating cause of death. Seller also reserves the right to require a DNA sample and microchip scan from the puppy.


VET CARE: Buyer Must agree to keep puppy under the care of a Licensed Veterinarian throughout the dog’s lifespan. The Buyer agrees to feed this puppy a high-quality dog food appropriate for the breed of dog. If the Buyer allows the puppy to become overweight this health guarantee / contract is void. West Highland White Terriers that become overweight can develop joint problems, metabolic and digestive disorder, back pain and heart disease. Make sure your Westie’s weight is healthy for its height and age. Buyer agrees to keep up with age appropriate, veterinarian recommended vaccinations and deworming regimens.


Picking Up Your puppy: Your puppy needs to be picked up between 8-9 weeks of age. If your puppy is not picked up by the 8th week and no prior arrangements have been made with the seller, seller has the right to void this agreement and find another buyer. Deposit is nonrefundable in this case as well.


Shipping of puppy: Puppies are shipped at no earlier than 8 weeks of age and will be guaranteed for up to 72 hours from shipping date. Along with the price of the puppy, Buyer is responsible for shipping fees. Fees are determined on weight of puppy and where it is being shipped to. Seller is not responsible for the death or injury of puppy due to negligence of airline, live animal carrier, or any agent or employee of the airline or animal carrier. All shipping costs related to any dog being purchased, as well as in relationship to any dog being replaced for any reason, are the sole responsibility of the buyer. Seller is in no way responsible for any expenses associated with the puppy after the puppy leaves the possession of the seller.


First Right of Recovery: If buyer is unable to care for or chooses to change his/her mind about caring for the puppy purchased, seller retains the first right of recovery of the puppy at the buyer’s expense. The buyer must notify seller to the change in circumstances and give the seller first right to the puppy before any other action is taken. This includes and is not limited to selling the puppy to another buyer. Buyer agrees that if this puppy is offered for sale or trade at any time in the future, it will first be offered back to seller. If the puppy is being sold it will be offered to seller at a purchase price not to exceed the original price of puppy and minus the nonrefundable deposit. This puppy must NEVER be sold to a pet store, broker, puppy mill, or surrendered to a shelter. Breeder must be notified immediately of any problems that arise or if buyer cannot care for puppy anymore. Seller has the right to rescue this puppy if it is found to be mistreated, neglected, or abused and buyer does not voluntarily return it. Any mistreatment, neglect, or abuse of the animal voids all health guarantees given.


BREACH OF CONTRACT: In the event the purchaser is found to have violated any of these terms and conditions of this contract, the puppy is to be surrendered unconditionally to the seller. Seller will not refund money in whole or part for any reason other than stated in the guarantee. Seller may reclaim physical and legal ownership of puppy with or without due process of law for any breach of contract with no refund of purchase price. In the event the Purchaser is found to have violated any of the terms of this contract, Purchaser shall be liable to the seller for damages in the amount of two times the purchase price of said puppy, plus expenses for veterinarian care upon return of puppy to seller, and all attorney, legal and related miscellaneous fees that result in litigating this contract. Any legal action, which may arise under the terms of this contract, will be brought in the county/city of seller’s residence. This document is a legal and binding contract. This contract is to be governed by the laws of the State of Iowa. Seller and Purchaser signatures indicate full agreement and approval of all the above terms and conditions of this contract. There are no other conditions or guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined above. I acknowledge that this is a legal & binding contract and have reviewed and agree to the terms listed above. Failure to follow the above contract completely will result in “A Breach of Contract” and shall make this contract null and void. This contract applies only to the original purchaser and is NOT transferable. When the seller receives a deposit, the buyer automatically agrees to the terms of this contract, even if both the seller and the buyer have not yet signed the contract.

All legal fees, collection agency fees, or any other fees, which would be incurred to enforce this contract will the sole responsibility of the BUYER. Buyer is responsible for all legal fees of Seller if a court rules in favor of Seller and enforces this contract in a dispute. Seller will not be held responsible for the Buyer’s vet or lawyer fees accruing after this adoption.


By signing this document, both parties acknowledge that they have read, understand and agree to this contract. Both parties have a copy of this contract.
